NuVion Health Affiliate Program Terms

These terms govern participation in the NuVion Health affiliate program. By registering as an affiliate, you agree to these terms. NuVion Health may update them at any time, with continued participation constituting acceptance of the current version.

1. Eligibility and approval

Affiliate applications are reviewed and approved at NuVion Health’s discretion. Approval is not automatic. We may decline or revoke affiliate status at any time without cause. You must be at least 18 years of age and, where you promote in a professional capacity, hold any registrations or qualifications you represent yourself as holding.

2. Commissions

Approved affiliates earn a commission of 20% on qualifying sales generated through their unique affiliate link, including subscription orders, calculated on the product value of each order excluding shipping and taxes (GST). Commission rates are as set out in your affiliate account and may be varied for individual affiliates. Commissions are recorded as pending, become payable after the applicable refund grace period has elapsed, and are forfeited on any order that is refunded, cancelled or charged back. NuVion Health reserves the right to withhold or reverse commissions arising from fraudulent, self-referred or policy-breaching activity.

3. Payment

Commissions are paid to the payment email nominated in your affiliate account once your approved balance meets the minimum payout threshold. You are responsible for any tax obligations arising from commissions you receive.

4. Permitted promotion and product claims

This section is a condition of participation. Australia regulates the advertising of therapeutic goods and related products, and breaches carry serious consequences for both the advertiser and NuVion Health.

You may only promote NuVion Health products using marketing materials, product descriptions and claims that NuVion Health has provided or approved in writing. You must not:

• make any therapeutic, medical, curative or health-benefit claim about any product, including claims that a product treats, prevents, cures or manages any disease, condition or symptom;
• make any claim that goes beyond the approved product information supplied by NuVion Health;
• represent any product as being for human consumption or use where it is not supplied or labelled for that purpose;
• provide, or direct anyone to, dosing, administration, protocol, cycling or stacking guidance for any product;
• use testimonials, before-and-after representations, dosing advice or endorsements not approved by NuVion Health;
• imply endorsement, sponsorship or approval by NuVion Health beyond your status as an affiliate; or
• run paid search, paid social or other advertising that bids on NuVion Health brand terms or misrepresents your relationship with the business, without prior written consent.

You are responsible for the compliance of any content you publish. NuVion Health may require you to remove or amend any content, and failure to comply promptly is grounds for immediate termination and forfeiture of unpaid commissions.

5. Conduct

You must not engage in spam, misleading or deceptive conduct, cookie stuffing, self-referral, trademark misuse, or any activity that damages the reputation of NuVion Health. You must comply with all applicable laws, including the Australian Consumer Law, spam and privacy legislation, and the advertising requirements applying to the products you promote.

6. Relationship

Nothing in these terms creates an employment, agency, partnership or joint venture relationship. You are an independent participant and may not enter into obligations on behalf of NuVion Health or hold yourself out as authorised to do so.

7. Termination

Either party may terminate participation at any time. On termination, unpaid commissions that were validly earned and are not subject to breach or refund will be paid at the next scheduled payout. Commissions associated with any breach of these terms are forfeited. Sections relating to product claims, conduct and liability survive termination.

8. Liability and indemnity

To the extent permitted by law, NuVion Health is not liable for any indirect or consequential loss arising from your participation. You indemnify NuVion Health against any claim, loss or penalty arising from your breach of these terms, including any non-compliant advertising or product claim you make.
